| UNITED XPERTS COURIER STANDARD CONDITIONS OF CARRIAGE
It is accepted between United Xperts Courier & the consignor or customer (hereinafter called the shipper) that the acceptance of this House Airway Bill by the shipper shall constitute the shipper's agreement to the following terms & conditions
1) United Xperts Courier will provide pick up & delivery services of documents & samples as requested & arrange for air/surface transportation as required. Such services shall be furnished as agents of the shipper, United Xperts Courier reserves the right to carry the shippers documents & samples or goods by any route & procedure & by successive carriers & according to its handling storage and transportation methods.
2) United Xperts Courier shall not be liable for any incidental, special for consequential damages. United Xperts Courier not be liable for any loss, damage, delay, misdelivery, unless proved to there was no contributory negligence by the shipper or consignee.
3) United Xperts Courier shall not be liable for any loss, damage, misdelivery, nondelivery or delay caused by acts of God. Public enemies weather, authorities of law, riots, strikes, labour disputes, war or mechanical or other delay of aircraft or vehicle used dividing transportation service.
4) Any claim by the shipper for loss or damage in accordance with clause 2 here of shell by noticed in writing to United Xperts Courier not later than 07 days after delivery of the shipment to the consignee. United Xperts Courier in not obligated to act on any such claims until shipper has paid all charges for transportation for same.
5) United Xperts Courier liability for delays losses or misdeliveries not caused by shippers negligence shall be limited to a refund of delivery charges only.
6) United Xperts Courier may at it's option inspect shipper packages prior to at after tendering to United Xperts Courier and reserve the right to refuse & package Shipper completes the insurance section on the front of the airway bill or requests it via United Xperts Courier automated systems and pays the applicable premium Shipment insurance doesn’t cover direct loss or damage cause by delays. which by reason of the dangerous or other character of its liable in the judgment of United Xperts Courier to soil taint or otherwise damage other merchandise of equipment or is economically or operationally impracticable to transport. United Xperts Courier shall not accept for transportation any dangerous hazardous material which are subject to regulation by the International Air Transport Association (IATA) or the International Civil Aviation Organization (ICAO).
7) The shipper warrants to United Xperts Courier that the shipment is sufficiently package to with stand ordinary handling while in transit as well as conditions incidental to transportation. All packages must be appropriately marked, security sealed & properly addressed to ensure the safety of the materials enclosed while in transit.
8) The shipper warrants to United Xperts Courier that the content of the shipment may be lawfully carried abroad airline, aircraft or other federally regulated carrier & is not prohibited commodity under & applicable statutes & regulations & is properly packaged or sheathed for the purpose of necessary the shipper will indemnify & hold harmless United Xperts Courier, against any loss by the latter as a result of the shipper violation of this provision.
9) No agent, employee or representative of United Xperts Courier has as authority to modify & provisions of these terms & conditions.
10) Carriage here under is subject to the rules relating to liability established by the convention for the unification of certain rules relating to International Carriage Air, signed at Warsaw on October 12th 1929 (hereinafter called the convention).
11) Shipper authorize United Xperts Courier and its agents to act as forwarding agent for shipement for export control & custom purpose. Shipper hereby certifies that all statements & information contained in this airway bill relating to exportation are true & correct. Furthermore, shipper understands that civil & criminal penalties, including forfeiture & sale, may be imposed for making false & fraudulent statements or for The violation of any national laws.
12) United Xperts Courier can arrange insurance for Shipper covering the actual cash value in respect of loss of or physical damage to the Shipment, provided the |
